FCC ANNOUNCES TENTATIVE AGENDA FOR JUNE 12TH OPEN MEETING

Washington, D.C. – Federal Communications Commission (FCC) Chairman Kevin J. Martin today announced that he has circulated the following items for consideration by his fellow FCC Commissioners as part of the tentative agenda for next month’s open meeting, scheduled for Thursday, June 12, 2008:

DTV: An Order on Clarification with respect to Petitions for Reconsideration of Clarification of the Third Periodic Review of the Commission’s Rules and Policies Affecting the Conversion to Digital Television.

National Do-Not-Call Registry: A Report and Order Addressing the Commission’s Rules under the Telephone Consumer Protection Act Concerning the National Do-Not-Call Registry.

Telecommunications Relay Service (TRS): A Notice of Proposed Rulemaking Concerning the Provision of Speech-to-Speech, a form of TRS.

A Report and Order and Further Notice of Proposed Rulemaking Concerning a Ten-Digit Numbering Plan for Internet-Based TRS.

Skype: An Order that would address The Skype Communications S.A.R.L. Petition to Confirm a Consumer’s Right to Use Internet Communications Software and Attach Devices to Wireless Networks.

Advanced Wireless Services (AWS) Spectrum: A Report and Order that would Adopt Service Rules for*AWS Spectrum*in the 1.9 GHz-2.1 GHz bands, an Order on Reconsideration that would address Petitions for Reconsideration of a Commission Order that addressed Applications and Forbearance Petitions to One of the*AWS Bands, and a Further Notice of Proposed Rulemaking that would Seek Further Comment Regarding Service Rules for the*AWS Spectrum.

The FCC will hold a Public Hearing on early termination fees in the Commission Meeting Room directly following the June 12th open agenda meeting.




Chairman Martin last month announced that topics selected for open meeting agendas will be made public and posted on the Commission’s website approximately three weeks prior to the upcoming monthly meeting. This step enhances the openness and transparency of the Commission’s processes and deliberations.

The Communications Act of 1934, as amended, requires the Commission to formally meet at least monthly. The Commission’s practice has been to issue a public notice of the “Commission Meeting Agenda” one week beforehand and announces the items that are scheduled for the agenda. With the Chairman’s action today, items the Chairman has scheduled for consideration by the Commissioners at the next agenda meeting will be issued and made available to the public through the Commission’s web site at: HYPERLINK "http://www.fcc.gov/" www.fcc.gov . In addition, the Commission will continue to issue the Commission Meeting Agenda at least one week beforehand as a standard practice.

Note in the article the following:

"...At a news conference, (FCC Commish) Martin said that a decision on the merger isn't on the agenda of the agency's open monthly meeting for June, but he added: "I still think the commission could act by the end of the second quarter."

The next open monthly meeting is June 12th

With the FCC, of course, this could be June 12th, 2009

If logic was involved a decision would come between now and June 12th

Martin has said that about other quarters. He has no credibility and I wouldn't pay him any mind.

Besides, Siriux/XM doesn't have to be on the meeting agenda. The drafts have been circulated and members can vote in private. I still doubt we'll hear anything before the meeting.
